Complications At Brix – Liens and Lawsuits

I’m sure this is exactly what Brix doesn’t need right now but they’re tangled up with their old contractor. There’s liens and the talk of a lawsuit:

Because of the dispute over the amount owed Clark, it is possible that Clark will file suit on the lien and name you as a defendent because you now own a portion of the condominimum. The bond that we have posted protects your property and releases it from the lien. If you are named as a party to any such suit, we will at our expense defend you and ask the court to dismiss you from the action because we have posted a bond.

How interesting that W.G. Clark filed the lien against the Brix property on September 17, 2008 and buyers who had put money down on their condos were somehow not notified of this fact until January 12, 2009

I speak from experience. We eventually withdrew from our deal to purchase a Brix condo at a considerable $$ expense to us and bought a place in a different development with a lot less er… volatility. A far better price, amenities and location made it more than worth it. Turned out to be a great place and we love living there.

Not to dis the sales folks at Brix (who were for the most part, super friendly), but this kind of semi-crookedness, half-information and surprise extra fees seemed to crop up again and again during our whole process there. We were not really comfortable with that.

It is a tad humorous to see a letter which announces you might be hauled into the middle of a messy lawsuit ending with “sorry for any inconvenience”. :)

Nitsuj, you’re right. This is definitely par for the course with condo sites in Seattle. Any other place in the U.S., and you would find clear, concise protocol for your questions as well as the on-site agents being upfront from the beginning in order to mitigate liability to the developer.

In this particular instance, I feel there is a tremendous amount of liability on the developer for not having notified in advance the potential owners of the condos prior to closing. Can you say “class action?”

We like to feel special here in Seattle but the city is not alone when it comes to “semi-crookedness” in development projects. I have personal experience with the problem in San Francisco. I bet it has more to do with the nature of developers in general than any local influence.

I own a place at Brix and I have to say that I absolutely love this building and think that it is a fantastic value in Capitol Hill for the location, finish and over all building attractiveness.

Just to make it clear, this is not the first time that the buyers and owners at Brix were notified of this lien. It was part of the title report that was received before closing on the home. It is not a surprise to any owner that completed their due diligence in reviewing the materials that they are responsible to review as a buyer. I was assured by the title company that this lien would not be of any consequence to me, as an owner, as the title company is insuring around the lien. The bond is in place to pay WG Clark.

It is true that it is very common for contractors to file liens against properties to ensure they are paid. How often are there disputes, when dealing with contractors, over the quality of work, amount billed and actual work completed? My opinion… pretty much always.

I think this is being blown totally out of proportion.

I checked out “Brix Owner”. Turns out they’ve previously posted (twice before) and in those posts identified themselves as a real estate agent and a site agent (don’t know which project.) This doesn’t mean they aren’t also a Brix owner though.

Yes, I am a realtor and a site agent, but I have no affiliation with Brix sales or development other than being a happy homeowner. I am selling a different condo project.

I find this blog and forum a great way to understand what people are thinking about the downtown market and to be honest I find it somewhat humorous how skeptical people can be when presented with honest and truthful information meant to help inform and educate a possible buyer in todays market based on experience and knowledge.

I have sold somewhere around a dozen condo projects around the greater Seattle area. I mention that construction liens are more common than most people know because I can think of at least 4 projects that I have been involved with on the selling side that have had liens placed against the developer and then eventually against the buyers as they close. I have never, in any of those instances, seen the homeowners held responsible for the liens. I don’t believe, as a homeowner at Brix, that I am being “lackadaisical” over the lien issue. I just think I did the proper research to be sure that I am protected against what may or may not come as a result of the lien.

I presented this information to try and curb what appears to be a panic approach to any negative information found about today’s market.

I will continue to contribute if I feel that I may be able to provide some insite to the other side of this forum to help bridge the gap of understanding between the consumer/buyer and those on the other side. Feel free to take it for what it’s worth. Believe or don’t believe me, I don’t know that it really matters. But there is always more than one side to a story. I think it’s important to remember that.

Because you are an agent, it IS important to disclose your profession to readers as your views/opinions are naturally weighted toward the rights of the Seller. Clearly that showed through as I was easily able to recognize you as an agent that had doubled up your member name, right? Why would you do that? In fact, I feel anyone who’s profession is closely related to the industry, including developers, contractors, agents, marketers, and bankers, have an obligatory duty to their readers to disclose that information. You’d probably find people would lend you MORE credibility if you were upfront about it from the start. Instead, we’re shaking our heads and saying, “yep, just another agent trying to put his/her spin on a potentially harmful situation to the buyers.”

I don’t find that it was a “panic” approach as you put it. However, given that you have taken such a less-than-upfront approach when writing about the ordeal, I actually NOW find the situation at Brix to be MORE concerning than previously thought.

Technically, you can lose your license for not disclosing the lien. Also, construction liens going to full litigation is NOT common, although disputes usually are.

I’m a Brix owner, I’ve posted before, and I could care less about the lien. There is a bond covering the amount of the claim. As a result, from a buyer’s perspective, it’s pretty much a non-event.

I’ve had nothing but a positive experience with the sales staff, the developer and the preferred lender. I was disappointed with the delay in completion of the building, but I never experienced any sort of “hidden fees” and I’m happy not to be paying for amenities that I’d never use. The building is beautiful, I love my unit and I love living so close to all the shops and restaurants on Broadway.

I am a contractor (Katwall, Inc.) who was called in by the Construction Manager ,Andersen Construction who was hired to save the project after WG Clark was FIRED and worked for the developer Schnitzer West who is also one in the same as Brix LLC, on this project and they have changed all my billing's to amounts they chose and they held 5% retention on my payments on a Time and Material contract. I have paid all my supplier's and all my labor and they REFUSE to pay me the retention they held on the payment amount they agreed on… they owe us $ 74,000.00. This after I gave them about $ 40,000 free pick up work and then they changed my last invoice to about $ 50,000.00 less than they owe.
TODAY (MARCH 5, 2009) I AM FILING A NEW LIEN AND I AM OWED THE MONIES NOTED ABOVE BUT, I am only going after the retention. Brix LLC wants to make a deal at $ 7,500.00 but, they clearly owe more. I am a female owned company and I am a little guy in the business word, the kind or business these Brix people are out to destroy and put out of business so they won't owe them anymore. They think I shouldn't be paid because I made enough money already. Do you think they will refund all the buyers at the end if they make money selling the units? HA HA They won't. Brix is a legal mess… WG Clark is not getting paid they are 1% owners of the project. They did horrible substandard and behind schedule work on the project and were removed from the project because they were way off schedule and needed help to complete the job. WG Clark is 1% owner in the project as a scam to save sales tax.
DON'T BUY BRIX and DON'T BELIEVE THE LETTER THEY WROTE STATING SORRY FOR THE INCONVENIENCE.
THEY AREN'T SORRY, THIS IS BIG BUSINESS AND THEY ARE IN IT TO MAKE MONEY.

THEY AREN'T SORRY, THIS IS BIG BUSINESS AND THEY ARE IN IT TO MAKE MONEY.
If you BUY BRIX and think they money will go to pay the hordes of subcontractors that are owed on this building you are wrong. It will just pay off the loans and line pockets of the big business developer on the project.

The Brix LLC letter is a joke. Don't get involved. Run to another condo!!!!!
I am a contractor (Katwall, Inc.) who was called in by the Construction Manager ,Andersen Construction who was hired to save the project after WG Clark was FIRED and worked for the developer Schnitzer West who is also one in the same as Brix LLC, on this project and they have changed all my billing's to amounts they chose and they held 5% retention on my payments on a Time and Material contract. I have paid all my supplier's and all my labor and they REFUSE to pay me the retention they held on the payment amount they agreed on… they owe us $ 74,000.00. This after I gave them about $ 40,000 free pick up work and then they changed my last invoice to about $ 50,000.00 less than they owe.
TODAY (MARCH 5, 2009) I AM FILING A NEW LIEN AND I AM OWED THE MONIES NOTED ABOVE BUT, I am only going after the retention. Brix LLC wants to make a deal at $ 7,500.00 but, they clearly owe more. I am a female owned company and I am a little guy in the business word, the kind or business these Brix people are out to destroy and put out of business so they won't owe them anymore. They think I shouldn't be paid because I made enough money already. Do you think they will refund all the buyers at the end if they make money selling the units? HA HA They won't. Brix is a legal mess… WG Clark is not getting paid they are 1% owners of the project. They did horrible substandard and behind schedule work on the project and were removed from the project because they were way off schedule and needed help to complete the job. WG Clark is 1% owner in the project as a scam to save sales tax.
